Strategic litigation - a useful tool for Labour in Opposition?
|In recent years, public law and human rights challenges have been used to abolish employment tribunal fees (R (UNISON) v Lord Chancellor), limit the application of the dreaded ‘Bedroom tax’ (R (Rutherford) v Secretary of State for Work and Pensions), and overturn the Home Office’s pernicious policy of deporting EEA rough sleepers (Gureckis v Secretary of State for the Home Department).
